TERMS AND CONDITIONS
By submitting an entry to any contest hosted by The Center for Arts and Innovation, Inc. (“Organization,” “we,” “us,” or “our”), the participant (“Participant”) or the parent or legal guardian of a participating minor (“Guardian”) agrees to be bound by these Terms and Conditions (“Terms”).
- ELIGIBILITY
Contests are open to individuals aged 6-18 years old at the time of entry. Participants must be legal residents of Florida. Each Participant may submit only one entry per contest unless otherwise specified. Employees, board members, volunteers of the Organization and their immediate family members may participate but are not eligible for any awards or prizes.
- CONTEST ENTRY
Submission Requirements
- All entries for Participants under 18 years of age must be submitted by a parent or legal guardian on behalf of the minor Participant.
- Entries may be submitted online through our official website, by mail, or in person at designated Organization events.
- Submissions must include completed entry form with Participant and parent/guardian information, if applicable.
- All required fields must be completed for entry to be valid.
- No purchase is necessary.
Entry Materials
Depending on the specific contest, Participants may be required to submit on or more of the below:
- Short films (specifications will be provided for each contest).
- Written stories or essays.
- Artwork or creative projects.
- Other creative materials as specified in individual contest rules.
Technical Requirements
- All digital submissions must meet file size and format requirements specified for each contest.
- Submissions must be the original work of the Participant.
- Entries must be appropriate for all audiences and align with the Organization’s mission and values.
- INTELLECTUAL PROPERTY RIGHTS
Grant of Rights
By submitting an entry, Guardian and Participant hereby assigns to the Organization all intellectual property rights in and to the entry including, without limitation, any ideas, concepts, text, graphics, images, or other intellectual property included herein, provided that the Participant is given such credit for the entry as the Organization may, in its reasonable judgment, determine. Neither the Participant nor the Guardian will be compensated for any entry. The Organization grants the Guardian and Participant the perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display the submitted work. The Organization may use the Participant’s name, likeness, photographs, videos, biographical information, and submitted work for promotional, educational, and marketing purposes. Guardian and Participant expressly agree that the previous sentence shall be deemed consent for the publication of the Participant’s name and likeness under Florida Statute 540.08. Additionally, the Organization reserves the right to create derivative works based on the submission and may use submissions within the Organization’s facilities, at the Organization’s events, and across all media formats, including (but not limited to) print, digital, broadcast, online platforms, programs and physical spaces.
Participant Representations
Guardian (and Participant, if the Participant is 18 years of age) represents and warrants that:
- The submitted work is entirely original and created by the Participant.
- The submission does not infringe upon any third-party rights.
- If the Participant is younger than 18 years of age, Guardian has full authority to grant these rights on behalf of the minor Participant.
- All necessary permissions have been obtained for any third-party materials included in the submission.
- PRIVACY AND DATA PROTECTION
Information Collection
We will collect information necessary for contest administration, including:
- Participant’s name, age, and contact information.
- Guardian’s name and contact information.
- Submitted creative works and related materials.
- Participant photographs and videos.
Information Use
Collected information may be used to:
- Administer the contest and communicate with Participants.
- Promote the Organization’s programs and future contests.
- Comply with legal requirements.
- Showcase and promote the contest submissions.
- Improve, create, and execute our programs, spaces, and services, whether for revenue or otherwise.
Information Sharing
We do not sell Participant information to third parties. Information may be shared with:
- Contest judges and evaluation personnel.
- Service providers assisting with contest administration.
- Third-parties solely with respect to showcasing and promoting the Organization, the Participants, and the contest submissions.
- Legal authorities when required by law.
- CONTEST RULES AND JUDGING
Judging Process
Entries will be evaluated by qualified judges selected by the Organization and judging criteria will be specified for each individual contest. Judges’ decisions are final and binding. The Participant and Guardian acknowledge that no guarantees have been made. The Organization reserves the right to disqualify entries that violate these Terms.
Prizes and Awards
Prize information will be specified for each individual contest and are subject to availability. Prizes may change. Winners will be notified using contact information provided during entry. If a winner does not respond in a timely manner, an alternative winner may be selected in the Organization’s sole discretion.
- GENERAL TERMS
Limitation of Liability
The Organization is not liable for any special, consequential, or indirect damages arising from contest participation. The Organization’s total liability to Guardians and Participants will not exceed $500 in any event. Guardians and Participants agree to participate at their own risk. The Organization is not responsible for technical failures, lost submissions, or other issues beyond its reasonable control.
Waiver
By attending and participating in any in-person event, the Guardian and Participant, as applicable, acknowledge and agree that participation involves inherent risks, including but not limited to physical activity, interaction with other attendees, and potential exposure to hazards, and voluntarily assumes all such risks. Guardian and Participant, on behalf of themselves and any minor under their care, hereby release, waives, and discharge the Organization, its officers, employees, agents, and affiliates from any and all liability, claims, or demands arising out of or related to any loss, injury, illness, or damages sustained during or in connection with the event, whether caused by negligence or otherwise, to the fullest extent permitted by law.
Indemnification
Guardian and Participant agree to indemnify, defend, and hold harmless the Organization, its officers, directors, employees, and volunteers from any claims, damages, or expenses arising from (a) any Guardian’s or Participant’s participation in any Contest and (b) any claim that the Participant’s submission infringes upon the rights of any other person.
Modification
The Organization reserves the right to modify, suspend, or terminate any contest at any time and for any reason.
Governing Law
These Terms are governed by the laws of Florida without regard to conflict of law principles. Any dispute arising hereunder, or related to the terms hereof, will be brought exclusively in the state or federal courts located in Palm Beach County, Florida.
Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between the parties regarding contest participation and supersede all prior agreements or understandings.

PARENTAL CONSENT AND AGREEMENT
By submitting your entry, you are agreeing that:
- I am the parent or legal guardian of the Participant named in the entry form OR I am the Participant and I am 18 years of age.
- I have read and understand these Terms and Conditions.
- I agree to be bound by these Terms on behalf of myself and, if applicable, the minor Participant.
- I consent to the use of the Participant’s submission, name, and likeness as described in these Terms.
- I confirm that the Participant is between 6-18 years old and eligible to participate.
